This notice contains the legal terms and conditions that regulate the website www.sabbatiniturco.com (hereinafter “Site”). By accessing the site, users undertake to accept and agree to comply with all the conditions contained in this declaration. FIVE GROUP S.r.l.s. reserves the right to ask Users who do not accept or do not intend to comply with these terms to refrain from using the website. Access to the site and its services is intended exclusively for personal use. The site is the property of FIVE GROUP S.r.l.s.. FIVE GROUP S.r.l.s. may modify the contents of the site at any time, including the commercial conditions expressed therein, without having to give any notice. FIVE GROUP S.r.l.s. declines all responsibility for the possibility that, due to a particular configuration of the computer used by the Customer or a malfunction thereof, the colors of the products displayed on the site may present slight differences compared to the original ones.
Terms of Sale
The sale of products contained in the virtual catalogues on this site (hereinafter “Products”) is governed by the following General Conditions of Sale formulated in compliance with the legislation on contracts concluded outside of commercial premises. FIVE GROUP S.r.l.s. is authorised to manage an e-commerce system and is the only party responsible towards the Customers themselves, with the company expressly excluding any liability of any kind. The sales contract can be concluded in the following languages: Italian and English.
Contractors
The sales contract will be deemed to be made between: FIVE GROUP S.r.l.s. with registered office in Cisterna di Latina (LT) – Italy, with the Customer: the person (natural or legal person) who has transmitted an order via the site that has been accepted by FIVE GROUP S.r.l.s. The application of any other contractual conditions is excluded, even if not expressly disavowed by FIVE GROUP S.r.l.s.
Application of the General Conditions of Sale
Before making a purchase, the Customer is invited to carefully read these General Conditions and is authorized to store, reproduce, download a copy and/or print them. For any further information, the Customer is invited to contact the site’s customer service at the email address info@sabbatiniturco.com. By completing the formalities required to place the purchase order, the Customer declares that he/she has read the formalities and fully accepts the General Conditions of Sale. The general conditions of sale may be modified over time by FIVE GROUP S.r.l.s., and any modifications will become valid upon publication on the site. The conditions in force at the time of purchase will be applicable to each contract.
Product Sale Description
The service for the sale of Products activated on the Site includes registration, access to the selections, the choice of Products, the online transmission of the purchase order and the possible online acceptance of the purchase order.
Registration
The purchase and/or registration imply acceptance of the General Conditions indicated above which regulate the contract for the supply of the Products, as well as consent to the processing of personal data. In the event of registration, the Customer is required to keep the password with the utmost diligence, undertaking not to allow the use of the service by third parties not expressly authorised by him, for whose online behaviour he assumes full responsibility. In the event of loss, theft or misplacement of the password, the Customer will have the right to activate the procedure for issuing a new password on the Site. In the event that the customer wishes to cancel his account, he is required to send this request to the Customer Service e-mail address.
Purchase Order
Each purchase order received by FIVE GROUP S.r.l.s. must clearly contain information about the Product code, its description, quantity, address and name of the recipient. The ordering procedure on the Site provides the possibility of identifying and correcting data entry errors before sending the purchase order. The purchase order sent by the Customer constitutes a binding contractual proposal for the Customer. To confirm receipt of the order, FIVE GROUP S.r.l.s. will send the Customer a summary email to the email address indicated in the registration. The email in question is for information purposes only and does not constitute acceptance by FIVE GROUP S.r.l.s. of the order itself.
Acceptance of Purchase Order
FIVE GROUP S.r.l.s. reserves the unquestionable right to accept or reject the purchase order submitted by the Customer. FIVE GROUP S.r.l.s., without prejudice to the provisions of the following paragraph, undertakes to process the Customer’s order or to notify him of any problems, without delay and in any case no later than 7 days from the day following the day on which the Customer sent the order. It is understood that the execution of the order is subject to the actual availability of the Products. In the event of unavailability of the Product and/or in the event of non-acceptance of the order, FIVE GROUP S.r.l.s. will promptly inform the Customer and reimburse the same if payment has already been made. In this case the Customer will not be entitled to any other compensation or reimbursement. Orders submitted by persons who have not reached the age of majority will not be accepted.

Product Features
The Products are depicted in the online Catalogue in such a way as to correspond, as closely as possible, to the exact characteristics possessed. The images published having the value of generic information material may not exactly correspond to reality. The Products depicted in the online Catalogue may be purchased until stocks run out, it being understood that FIVE GROUP S.r.l.s. reserves the right to not make available, at any time, some Products and/or to modify their characteristics. FIVE GROUP S.r.l.s. also reserves the right to update, at any time, the online Catalogue, modifying the range or number of products.
Prices and Currency
The price of the Products is that resulting from the Price List published on the Site and in force at the time the order is sent by the Customer. The prices of the Products published on the Site are inclusive of standard packaging and/or wrapping and VAT (with the exception of non-EEC countries), the rate of which is determined in relation to the type of Product. The prices do not include transport and delivery costs. All the aforementioned costs (for delivery and special packaging/wrapping), not included in the prices of the Products published on the Site, will be separately indicated in the order summary and confirmed in the order acceptance email that will be sent to the customer by FIVE GROUP S.r.l.s.. Furthermore, for deliveries to be made in EU countries other than Italy and in Other States, in Campione d’Italia, Livigno, the Channel Islands and the Canary Islands, the prices of the Products published on the website are always intended not to include:
- any sales taxes and/or duties.
- any customs duties and/or charges.
- any other taxes and/or charges applicable to the delivery of the Products ordered.
The Customer will be required to pay all applicable taxes and customs charges in the country of delivery of the ordered Products. Any and all charges or costs relating to customs clearance of the delivered Products will remain the exclusive responsibility of the recipient of the delivery. Orders are invoiced in the currency of our sales price list of the country to which you are interested in shipping. The amount that will be charged to your credit card or Paypal account may vary as it is based on floating exchange rates and bank commissions. Customers are invited to contact their bank to request detailed information on exchange rates and bank commissions relating to their transaction.
Payment Methods
Payment by credit card of the Visa, Mastercard, American Express and Maestro circuits must be made online, at the time of transmission of the purchase order. The Customer will be asked to provide the details of his/her credit card in the purchase order and the request to debit the corresponding amount will be forwarded only when the order is completed. The Customer’s credit card details sent during the transmission of the purchase order are not accessible to FIVE GROUP S.r.l.s., nor to third parties and are received, in a manner protected against unauthorized access, on the secure servers of Multisafepay, PayPal, Stripe, Sofort/Ideal, Amazon Pay, Applepay, Google Pay, Scalapay, Clearpay which handle, on behalf of FIVE GROUP S.r.l.s., credit card payments. Credit Card Security
Since all transactions are processed by Paypal, Stripe and Multisafepay, Customers are guaranteed maximum security on the purchase. Customer Service operators are in no way authorized to request or accept credit card numbers and/or expiration dates of the same.
Payment via PayPal Verified Account
By choosing the Paypal payment method, the customer can pay directly through his verified Paypal account. Paypal payments from Verified accounts are accepted and reserves the right to ship the goods to the address indicated on the account verified by Paypal. Payments sent from unverified Paypal accounts may be canceled. Please note that if you select the Paypal fast checkout payment button, the shipping address is taken directly from your Paypal account.
Amazon Pay
Amazon Pay is an online payment method offered to Amazon customers, usable wherever the Amazon Pay button is, to make online payments. There is no need to register or log in. Transactions are safe and secure, and everything can be monitored from your Amazon account. Amazon Pay uses the information and payment methods stored in your Amazon account, including your address list, so you always have them at hand. The first installment is charged at the time of purchase. The other 2 installments will be charged in the following 2 months. In the event of cancellation or return of the order, the paid installment will be refunded while the others will be cancelled and not charged.

Customers can pay in 3 installments by selecting the Clearpay payment method. You must be a cardholder, be over 18 and have a Clearpay account. Right of Withdrawal
The Customer has the right to withdraw from the Contract within 14 days of receiving the purchased goods. The Customer must follow the procedure for requesting authorization for the return in the My Account area and specified here. The Customer must return, at his own risk and responsibility, the purchased Products, intact and complete (including any original packaging of the item), no later than 14 days from receiving the purchased Products. The Customer must return, at his own risk and responsibility, to the address indicated above, the purchased Products, intact and complete (including any original packaging of the item), no later than 14 days from receiving the purchased Products. For the sole purpose of expiry of the aforementioned 14-day period, the Products are considered returned when they were delivered to the carrier. The withdrawal can be exercised for the entire purchased Product and therefore cannot be operated in relation to only a part of the ordered goods.
Conditions
- The Products must not have been worn, washed or altered and must not show any signs of use.
- Each product must be returned including all the original labels, packaging and accessories received with the order. All products must be returned together with their original box, which is considered to all intents and purposes an integral part of the product itself and which must not have been damaged and/or altered in any way.
- In the event that the Customer receives defective goods, or that errors occur in shipments by FIVE GROUP S.r.l.s., it is required to follow the same instructions listed above (return). FIVE GROUP S.r.l.s. reserves the right to request photographic evidence before authorizing returns for defective goods and to bear the shipping costs for the return of the goods to its premises.
- All returned products are subject to inspection and must comply with all the parameters listed in the return procedure.
- FIVE GROUP S.r.l.s. reserves the right to refuse unauthorized returns or returns sent with couriers other than FEDEX/DHL EXPRESS without prior authorization from customer service. Authorization must be requested via email to the customer service address.
- Returns are not permitted for customized products.
- The return must be delivered to the courier already packaged in a way that allows transport without damaging the items inside.
- Please note that for items in the EMPORIO OUTLET section and the DISCOUNTCODE-20% promotion, returns are at the customer’s expense and care and it is possible to use a courier of your choice.
Upon verification of the integrity of the product (as per the General Contract Conditions), the cost of the item(s) will be refunded while the shipping costs paid at the time of purchase will be retained by FIVE GROUP S.r.l.s. In all cases in which the withdrawal is not legitimately and validly exercised by the Customer, FIVE GROUP S.r.l.s. will return the Product to the Customer, at the risk and expense of the latter; the Customer will also have to take care of the organization for the return of the goods. In the event that the returned Products are damaged during transport for redelivery to FIVE GROUP S.r.l.s. the Customer will be informed of the damage detected within the second working day from receipt of the Products, in order to allow the Customer to in turn inform the carrier and assert his rights against the latter and, at the same time, will return to the Customer the Products damaged during transport, at the risk and expense of the Customer himself. In the event that the withdrawal is exercised in accordance with the provisions of the current legislation, FIVE GROUP S.r.l.s. will refund the sums paid by the Customer. The refund of accepted returns will be free of charge, in the shortest time possible and in any case within fourteen days from the date on which FIVE GROUP S.r.l.s. received confirmation from its warehouse of the arrival and acceptance of the return.
FIVE GROUP S.r.l.s.. will not communicate the delivery of the return to its warehouses by the courier, the customer can personally inquire about the delivery through the shipper to whom the return shipment was entrusted.
The customer will receive an automatic email from our banking institution that will confirm the refund by FIVE GROUP S.r.l.s. within the expected 14 days.
FIVE GROUP S.r.l.s. is not responsible for the crediting times of the refunded amount which are totally regulated by the companies issuing the credit cards used.
